Beginning July 26, 1992, the Americans with Disabilities Act (ADA) required employers with 25 or more employees to consider reasonable accommodations for individuals with disabilities that create a barrier to employment. Beginning July 26, 1994, employers with 15 or more employees will be covered by the Act. To meet the requirements of ADA, organizations will need to aggressively: * Review job descriptions * Review physical activities & environmental aspects of all jobs * Establish procedures for analyzing essential functions of jobs * Determine how to successfully match jobs with applicants or employees with disabilities * Plan to meet reasonable accommodation requirements ADA's impact on all employment-related activities will be far reaching, including the application process, hiring, promotion, and termination. Most important for employers will be in understanding the actual job for which an individual is applying or works. As a result, job descriptions will be critical in meeting the ADA challenge. The ADA Position Analyzer! has been developed to respond to these challenges. To successfully comply with ADA, employers must completely analyze each job specifically. The Analyzer! can help organizations with a carefully constructed analysis of every position in the workplace. The Analyzer! assists managers and incumbents to systematically: * Analyze Physical Activities * Determine Environmental Conditions * Include Essential Functions * Record Equipment and Machines Utilized By presenting a series of screens from which the manager and position incumbent can select Physical Activities and Environmental Aspects of the job, the ADA Position Analyzer! demands an aggressive examination of each position. Optional screens are available to request information on Essential Duties and Machines & Equipment to include in the Analyzer!'s evaluation for those employers who have not yet developed job descriptions. After each position has been analyzed, the ADA Position Analyzer! records and saves the data in a permanent file. Each position analysis can be printed and used for: * Department and Human Resource Records * Interview Guidelines * Application Information * ADA Training * Determining Reasonable Accommodations * Evidence in Defense of Legal Action To be completely effective, the ADA Position Analyzer! works best in a dynamic environment that includes the manager and the incumbent of the position being analyzed. The direct knowledge of these individuals can be integrated to gain the most insight into the requirements of each position. * * * ADA Position Analyzer! Installation The following is necessary to run the Analyzer!: * IBM PC or 100% Compatible Computer * DOS 3.1 or Higher * 360 K of Free Memory * Dot Matrix Printer which emulates an Epson or IBM printer or an HP LaserJet Laser Printer The Analyzer! is designed so that no special installation procedures are required, but making a back-up disk is suggested. Place the Analyzer! Program Disk in Drive A:> and Blank disk in Drive B:> (for a dual floppy system) or in Drive A:> (for a single floppy system) and type the following: DISKCOPY A: B: (For a Dual Floppy System) DISKCOPY A: A: (For a Single Floppy System) To install the Analyzer! on a hard drive, put the Program Disk in Drive A:> (with the prompt set to A:>) and complete the following steps: MD C:\ADA! COPY *.* C:\ADA! To begin using the ADA Position Analyzer!, place the Program Disk in Drive A:> and type: ADA! or from the Hard Drive C:>ADA!\, type ADA!. The Analyzer! is ready to analyze any position in the organization and will lead management and position incumbents through carefully constructed screens to examine Physical Activities, Environmental Aspects, Essential Duties, and Machines and Equipment. * * * Making the Analyzer! Work for You An agreement statement appears the first time the ADA Position Analyzer! is used. To be able to access the Analyzer!, the user must indicate agreement with the terms of the ADA Position Analyzer! contract as stated in this software manual. Once the terms of agreement have been accepted, the Analyzer! Introduction Screen will be presented. After this initial confirmation of the licensing agreement, the Term's Screen will not appear when using the ADA Position Analyzer! in the future. The Introductory Screen offers the following choices: * Analyze ADA Data * Enter Duties, Equipment & ADA Data * Change Previously Entered Data * Delete ADA Data * Print Reports * Quit * Setup Options When Analyze ADA Data is selected by moving the cursor to this position and pressing , a series of questions directly related to the physical activities and environmental conditions of theposition being analyzed are presented. When an organization already has job descriptions that do not require revision, this option should be selected. When an organization has job descriptions that require revision or does not have job descriptions, move the cursor to Enter Duties, Equipment & ADA Data and press . This option provides an opportunity to enter Essential Duties and Machines & Equipment utilized in the position in addition to providing analysis of Physical Activities and Environmental Aspects of the position. Regardless of which of the two preceding screens the reviewer selects, five screens will follow: * Position Number * Position Title * Department Number * Department Title * Evaluator's Name After this information has been entered, the reviewer will enter Duties and Equipment if that selection was made and/or ADA Data. The Analyzer! presents several screens which ask basic questions on physical activities and environmental aspects of the job. The evaluator selects the dgree to which these relate to the position by moving the cursor from "NONE" to a range of percentage choices or answers questions posed about the position. Some screens offer an additional option that allows the reviewer to record "notes" about the position. Once the selection is made with the key, the next question is asked. After the reviewer has completed the analysis of the position, the Analyzer! prompts the evaluator to save the data and/or print it. Following selection of these options, the introductory screen appears for the next analysis or exit. The evaluator can call up, review, and change previously entered information by selecting Change Previously Entered Data. Previously entered positions can be deleted by selecting the Delete ADA Data. Previously evaluated positions can be printed by utilizing the Print Reports options. The Setup Option allows the reviewer to perform the following activities: * Set Screen Colors; * Set Report Form Length for Printing; * Set/Maintain Data Files - Separate data files can be developed for departments, divisions and/or companies; * Modify/Create Report Footer - Provides the ability to create a statement at the end of the report as a notice or as a disclaimer; * Re-index/Purge Data Files - Allows the Analyzer! to remove files that have been deleted and to arrange all new files; * Save Setup Options; and * Exit The ADA Position Analyzer! is a simple and complete way to review positions and to assist organizations in meeting the challenges of ADA compliance. Designed to assist supervisors, employees and those seeking positions better understand the dynamics of each position, the Analyzer! helps make appropriate selections, placements, and transfers so that both the organization and people with disabilities can be successful. * * * Software License Agreement Please read this License Agreement (hereinafter Agreement) carefully, and be sure to accept its terms before using the ADA Position Analyzer! (hereinafter called Analyzer!). When using the Analyzer! the first time, the user will be presented with a screen acknowledging this licensing agreement. A response to this screen will signify agreement with the terms of this license and will gain access to the Analyzer!. Failure to accept the terms will cause the Analyzer! to be returned to the prompt. In the event that the user elects not to accept the terms of this agreement, return the Analyzer! within 30 days of purchase and a full refund will be made. Since the Analyzer! is guaranteed to satisfy the professional requirements of the user, it may be returned open or unopened. * LICENSE Grandview Health Resources (herein GHR) grants the purchaser, and the purchaser accepts, a non-exclusive, personal, and non-transferable license to use the Analyzer! in any form to any party without prior written consent by GHR. * COPYRIGHT The Analyzer! and its documentation are copyrighted with all rights reserved. The purchaser may not remove or obscure GHR's copyright and trademark notices in either hard copy or machine readable portions of the Analyzer! without prior written consent of GHR. * WARRANTY GHR warrants physical media on which the Analyzer! is distributed to be free from defects in material and workmanship for a period of 90 days from the date which the Analyzer! is delivered and shall replace any such media free of charge. * DISCLAIMER Subject to the preceding "Warranty" information, GHR provides the Analyzer! as is without warranty of any kind, either expressed or implied, including the implied warranties of fitness for a particular purpose or merchantability. * LIMITATIONS OF LIABILITY In no event shall St. Luke's Health System, Inc., GHR, or anyone involved in the creation, production, marketing, or delivery of the Analyzer! be liable for any direct, indirect, incidental, special, consequential, or any other damages rising out of the use of the Analyzer! by any person, whether or not GHR has been informed of the possibility of such damages in advance. Some jurisdictions do not allow the exclusion or limitation of incidental, consequential damages, so the above exclusion of limitation may not apply to the purchaser. It will terminate if the purchaser fails to comply with any terms or conditions of this Agreement. The purchaser is obligated upon termination to return the Analyzer! to GHR together with all copies, modifications, and any data files related to the Analyzer!. * LAW This law shall be governed by the laws of the state of Iowa and shall inure to the benefit of GHR, its successors, and assignees. * ENFORCEABILITY The invalidity or unenforceability of any provision of this Agreement shall not affect the remaining provisions herein. * SOLE AGREEMENT This is the only Agreement between the purchaser and GHR. It cannot and shall not be modified unless in writing and signed by both the purchaser and an authorized officer of GHR. * MISCELLANEOUS GHR shall not be liable for any default resulting from any circumstances beyond reasonable control of GHR.
