CAL RETESTS RESCINDED The FCC has done an about face on forty-two of fifty-nine Southern California hams it ordered to be retested three weeks ago. Late word is that the commission has told the ARRL VEC that it has decided to process the license applications from three examination sessions that have been under scrutiny for the past several months. No explanation was given for the change of heart by the FCC, but it is believed that a number of those told to retest had instead threatened the government with violation of civil rights litigation. It is also believed that United States Senator Barbara Boxer had been approached by at least two applicants who asked that she intercede with the FCC on their behalf. A call to Boxer's office for confirmation or denial not yet been returned by the Senators staff. While a number of hams trying to upgrade may be off the hook, the same is not true for the three dozen or so California Volunteer Examiners ordered suspended last year by the FCC. The commission still does not want them testing. None of them have been reinstated by their respective VEC's and the government indicates that the probe of their activities is still ongoing. (***** CLARA The restraining orders issued several weeks ago against two Southern California hams may not be appealable on grounds of federal preemption. This is because several key words that the dealing with federal preemption over state and local law do not appear in the official hearing transcript. Attorney Sidney Radus, N6OMS represented the Claremont Amateur Radio Club who were the plaintiffs in the recent court actions. "I do have a copy of the transcript of the judges ruling in the action of Krist, Lowinger, Radus, Adhall vs Tony Cardenas Drew B. Feldman. And nowhere in his discussion does he ever mention Part 97.113 as a basis for jurisdiction in the state court. The jurisdiction in the state court comes from a number sources. It does not rely on 97.113." Sidney Radus, N6OMS. As far as we can figure out, the request by Cardenas and Feldman to change the venue of the hearing into the federal court based on federal preemption was a pre-trial motion. As such it may not have recorded in the actual transcript of the case. Meanwhile, Cardenas has been heard on a local Los Angeles repeater discussing a possible appeal based on an early 1970's case involving a ham accused of bothering a regional net. In that matter, the ham was reportedly successful in getting the action against him dismissed by citing federal preemption. He then filed a suit against his accusers and was awarded an undisclosed sum. Unfortunately, that legal action took place several years before the Newsline organization was founded. Because of this we have little information on it. Nor do we know if any binding precedents were set in that case. (***** NAL's ISSUED IN FLORIDA The FCC has issued Notices of Apparent Liability to Monetary Forfeiture to three Florida Citizen's Band operators. This for alleged violations of the Part 95 service rules that include the possible use illegal power amplifiers. The NAL's issued were for $1000, $1500, and $4000. All of the CBers involved have indicated their intention to appeal. (***** MISCELLANEOUS VIOLATIONS The FCC has also released a list of eight individuals cited for assorted violations including operating radio stations without proper authorization and operating on unauthorized frequencies. The fines here range from $250 to $6400. No other details were given in the FCC release. (***** WASHINGTON GETS LAW ON TOWERS AND ANTENNAS Washington State has new legislation to protect amateurs. Washington's governor has signed Senate Bill 5697 into law. The new statute limits the ability of municipalities to enact antenna and tower regulations by pointing out the federal pre-emptions of the FCC's PRB One. ARRL Washington State Government Liaison Frank Price, KD7AC says he credits Dr. Ralph Shumaker, WX7T, and members of the Mike and Key Club of Seattle with promoting this legislation. (***** DAYTON HAMVENTION FOLLOW-UP The official numbers are in. Even with the torrential rains that hit Ohio the last weekend in April, attendance at the 1994 Dayton Hamvention still broke the 33000 mark. The numbers prove that not even mother nature can keep true hams away from this world famous event. Nether rain nor wind nor cold deters amateurs from going to Dayton. Monitoring Times Magazine Publisher Bob Grove, WA4PYQ rates this years Hamvention excitement level almost off the scale. "From a stand point of enthusiasm it's incredible." Bob Grove, WA4PYQ. Heavy rains drive thousands of flea market fans inside Hara Arena Saturday, typically Hamventions heaviest day. With no shortage of people there's plenty of socializing. Every where you turn you hear plenty of sales pitches for the latest and greatest. Hams spend money at Dayton despite the dollars weak standing against the yen. "I think all the Japanese manufacturers are making a lot less right now, but the bottom line is they want to sell the product, so I think the manufacturers are going to make a little less profit in the short term." Yaesu USA's Kevin Karamanos, WD6DIH. At several forums it's standing room only. Among the most popular, the SAREX 10th Anniversary celebration moderated by Newslines own Roy Neal, K6DUE. And a special announcement at the Youth Forum. Young hams are about to get a special treat. The chance to make a extremely rare DX contact. Los Angeles resident Jim Neiger, N6TJ travels to Ascension Island May 20th. Jim has been an avid DXer since he was 15 years old. He plans to be on the air in the Novice bands to give young hams the chance to score both voice and cw contacts. "I will be arriving there, I said on the 20th. I should be on the air the night of May 20. I'm going to concentrate on working young amateurs on Sunday, May 22nd conditions warrant it. I hope to be on 10 meters 28.400 Mhz SSB from 1700 to 1800 zulu on May 22nd. Then at 1800 zulu I will QSY to 15 meter cw 21.125 Mhz." Jim Neiger, N6TJ. Jim wants to young hams to share in the thrill of rare DX. "I've been a ham since I was 15, 40 years in the hobby. I've been chasing DX since I was 15. It's time to try and give something back a little bit. I've been very negligent in spending time on the Novice bands and things, so I'm going to try and take an opportunity to spend more time doing that." Jim Neiger, N6TJ This years attendance 33,616. That's about 600 down from the year before. Transportation to Hara Arena, a major concern this year draws good reviews. "I believe the transportation from the designated parking areas has worked out extremely well. In reality I think it has worked better because we have a better flow of the buses. It's is not the long arduous trip, if you will, that we used to have from hotel to hotel. Now it's quicker." Jack Mitchell, AA8Q is a former Hamvention General Chairman. Back outside it's not just water falling from above. A single engine airplane, it's callsign hidden from view buzzes the arena less than 200 feet up. Suddenly the flea market is showered with flyers carrying dollar bills. A ham from Ashland, Kentucky grabs 9 dollars worth. "I had about nine of them and I gave two, three or four of them away I guess. Everybody just started grabbing them I said here and I just started picking them." Weather and crowds aside, Hamvention '94 was a weekend of information, activity, and fun. "Hamvention '94 of coarse is a phenomenon that's hard to describe. Seeing tens of thousand of amateurs all in one place at one time. It's something that's just not duplicated anything in the world. It's a pilgrimage we all must take. We take it, were not really sure why we are here, but we just know we will come back next year." Monitoring Times Publisher Bob Grove. There is general agreement Hamvention '94 was a good one. But if you want to play it safe next year, be ready for any kind of weather. In Dayton anything is possible! If you're a young ham and would like to have a shot at scoring that rare DX contact with Ascension Island, here again is information on frequencies and times. First, from the United States, turn your beam slightly south of east. Be listening for N6TJ Sunday, May 22nd. He'll be right in the middle of the Novice band at 28.400 KHz on sideband. He plans to be on the air between 1700 and 1800 hours Zulu. At 1800 Zulu, he'll switch frequencies to 21.125 KHz to work CW. If your code speed isn't all that fast, don't worry, Jim says he'll match your speed, get your call, and get your rare DX contact logged. (***** W6KG MEMORIAL FUND ESTABLISHED The ARRL says that it is the beneficiary of a life insurance policy left by famed DXer Lloyd Colvin, W6KG and it wants to use the proceeds to continue his work. As a result, the proceeds, more than 150,000, dollars, will now fund an endowment, the income from which will be used to further the strengthening of international friendship through DXing. Lloyd Colvin W6KG died last December while on another of his Yasmee (pronounced Yaz mee) DX operations. ARRL Executive Vice President David Sumner, K1ZZ says that during his lifetime Lloyd and his wife Iris, W6QL made many great personal contributions to international friendship through Amateur Radio. Announcement of the Colvin Fund was made at the International DX Convention in Visalia, California, on April 16th. Details of the administration of the endowment have not yet been worked out. (***** USE THE RIGHT FORM The ARRL is also asking anyone submitting cards to please check the DXCC application form you plan to use to insure it is the correct one. The current form is identified as MSD-505/194. It must be used for all new and endorsement applications since older forms lack spaces for critical information needed for processing your DXCC request. (***** UNITED KINGDOM NEWSLINE The United Kingdom now has a Newsline like service of its own. Citing a need to service its news hungry hams, the Radio Society of Great Britain has added a telephone hotline to augment its on-the-air Amateur Radio news bulletins. The RSGB over-the-air service is similar to ARRL's W1AW in that it is available on voice and packet. It differs from W1AW in that its read only once a week on a regional basis while ARRL issues bulletins daily. Newsline has sent a letter to the Radio Society of Great Britain offering them audio cassette copies of Newsline to add to their new GB2RS dial in telephone service. If the Society accepts our offer, Newsline will become the first United States based ham radio news bulletin service with a telephone outlet serving the UK and Europe.
