ShutDown NOW!© Shareware Software License for a single person on a single computer This software license belongs to the following software and all files coming with the software: ShutDown NOW!© version "xx.xx", Copyright 1996-97 by Carsten Stratz. This license replaces all former shareware software licenses of this software, as soon as it is made public, even if it is not yet read by the user of this software, but he could read it by getting the last version of the software from a public place or directly by the author of the software. This software is protected by the copyright law and international copyright treaty. Therefore, you must treat this software just like a book, except that you may copy it onto a computer to be used and you may make archive copies of the software for the sole purpose of backing up the software and protecting your investment from loss. By saying just like a "book", I mean, for example, that this software may be used by any number of people, and may be freely moved from one computer or location to another, so long as there is no possibility of it being used by more than one person at a time, except of the shareware nature of this software, described in paragraph one of this license. Just as a book can't be read by two different people in two different rooms at the same time without my permission. You can order another license for a multi user- and machine version of the software. The following license is valid for all users in all countries. If some parts of this license differ from the law of the country in which this software is used, all other parts of this license will stay valid. ShutDown NOW!© Shareware Agreement: By using this software the user agrees to use the software not longer than 14 days after the day of the first installation, except he pays for the software after this period of time, as described under the current payment conditions for the software. If the user decides not to use the software after 14 days or earlier, he has to delete the installed version of the software. The user commits to tell the correct number of computers (machines) and the number of users that will work with the software, if he wants to register the software. If this is not possible (e.g. if he wants to use the software on public locations), he has to estimate the number of users per day, that will work with the software or with the computers (machines) containing this software. The user is allowed to give this software to others under the following conditions: a) the version of the software is shareware and not registered (multi-user and -machine versions of this software are NOT shareware and are always registered), b) he spreads only an archive of the software, that contains all unused files of this software, c) he never tells a registration key number to a third person, neither by voice nor written, d) he never claims money for the software, except he distributes it together with other shareware software on: a Shareware CD-ROM or a Shareware Diskette. - Exceptions can be made and require a written contract. CARSTEN STRATZ OR HIS SUPPLIERS SHALL NOT BE LIABLE FOR (a) INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, EVEN IF CARSTEN STRATZ HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. 3.) High Risk Activities. The software is not fault-tolerant and is not designed, manufactured or intended for use or resale as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Carsten Stratz and his suppliers specifically disclaim any express or implied warranty of fitness for High Risk Activities. 4.) Jurisdiction, General Provisions: Valid in all questions of law is the German law and the German jurisdiction. All users of this software agree to the German law and the German jurisdiction.
