LICENCE AGREEMENT

NRich GraphX  © ( v.1.1a) :  
(hereinafter refered to as NRich or the software or it)
is a  SHAREWARE  version of an NRich(tm) software product.
It is NOT freeware.
It is NOT public domain.

Upon unpacking  NRich and keeping the software on some 
medium,  using the software beyond the entry screen or
reading this agreement,  you are effectively agreeing to be
bound to all the terms of this licence agreement. 
If you don't agree to all the terms, terminate the licence,
don't use the software and remove it from your computer 
and storage mediums.

(Suggestion: 
Remove any copy of the software and give it to someone
who could use the software and or associated benefits of NRich.)

I, David J.Toms, retain all my rights to ownership of the intellectual  
property rights I have associated with  this software including 
(but not exclusively) :
the main program entitled "NRich GraphX "© ,
supporting programs and files bearing the NRich (tm)  logo/trademark 
the logo/trademark itself, other files included.

(Notable exceptions include, but not exclusively,
Microsoft files and references to them are intellectual property of Microsoft,  
*.vbx, *.dll and supporting files 
are intellecual property of their respective creators/intellectual property holders, 
as are other files not mentioned above but not my intellectual property).

You do not own the software. It is licenced to you by David J. Toms.

As an individual user,
if you do not represent a business entity or enterprise
as a principal or agent  in using this software:
a)	You may have a limited licence to possess a copy and use 
	NRich (v1.1a  -  unregistered shareware version) for 
	personal and non-commercial use subject to the terms 
	of this agreement 
	for a period of  30 days.

b)	You may copy and distribute 
	NRich (v1.1a  -  unregistered shareware version)
	BUT 
	You can not sell /rent / lease it.



If you represent a business entity or enterprise as a principal or agent
in using this software (other than a mirror site, software repository on 
an online service, the internet, or a BBS) :

a) 	You,  and all other principals or agents of that entity,
	are permitted to use 
	NRich (v1.1a  -  unregistered shareware version) collectively 
	for an evaluation period of  30 days, 
	providing the entity accepts liability for purposes 
	of this agreement of ensuring the terms of this licence are 
	adhered to by all those using it.  
	All users must be exposed to this licence agreement.

b) 	You, as a representative of the entity or enterprise, 
	can not copy it to distribute/sell/rent/lend without a separate 
	written agreement granting the entity specifically, 
	among other rights, the right to do so.  

If you represent a mirror site, software repository on 
the internet, an online service, or a BBS:

a)	You can distribute it without a separate 
	written agreement granting this specifically.
	
	You can not sell /rent / lease it. 
	You may receive only connect-time costs to the amount 
	usually charged for connection costs associated with
	the service of providing your clients with such 
	shareware products.



Under the terms of this licence, if you have licence to distribute it,
it must be distributed as a single program.

You can not bundle Nrich(tm) shareware products with 
any other shareware or commercial software and distribute it 
as part of a package without the express written permission from
the author.

If distributed electronically by mirror sites or software repositories 
on the internet, online services or BBS's, it is not to be associated 
with any software other than other NRich(tm) software products.
It is to be treated as stand alone, posted as a separate shareware
product.

This software can not be distributed  accompanying
books or magazines without express written permission from
the author.

Except through distributing electronically by mirror sites or software repositories 
on the internet, online services or BBS's,
You can not include it with other information products or services
or merchandise products, for that matter, without express 
written permission from the author.

I make no representation about the suitability of
this software or about any content or information made
accessible by the software, for any purpose. 
You use NRich at your own risk, accept it as is,
with no implicit or explicit warranty or guarantee,
(including warranties of merchantability and fitness for a
particular purpose). 

As partial consideration due for the  limited licence to use this 
unregistered shareware version of NRich
you agree now to waive any claims of liability you may have
against me resulting from any damages whatsoever
incurred directly or indirectly, through use of this software,
even if I have been advised of the possibility of potential
damages. 

(This limitation of liability may not apply in some jurisdictions.
Any term or clause not permitted in your jurisdiction will not deem the 
other clauses null and it is agreed that the term or clause shall be 
enforceable to the maximum extent permitted under that jurisdiction. ) 

In any case, you agree that my total liability to you for any damages,
losses, causes of action of any form, will not  exceed what you paid 
for NRich (which happens to be nothing, for this 
unregistered shareware version of NRich).

You must  not change/modify  it in any way
(decompile it, reverse engineer it,
knowingly add a malicious or damaging
file (or code) to it, construct a derivative with it).

You keep all associated files included with it.

The licence for this 
unregistered shareware version of  NRich
is effective until it is terminated.
It is terminated after 30 days use. 
It is terminated immediately if you do not adher to all 
terms of this agreement. 
It is terminated any time you wish by removing the software from 
the medium you possess that contains it. 

I reserve the right to terminate the licence of any user of this 
unregistered version of NRich at any time.


If the above conditions can not be met,
you don't have the right to possess a copy of or 
use this software and are required to remove 
any and all copies of the software from your computer
and storage mediums (i.e.disks,etc.).

Failure to do so is either acceptance
of the terms or a contravention of my rights under
copyright law and creating a liability to me.
