License Agreement



THIS IS A LICENSE AGREEMENT AND NOT AN AGREEMENT FOR SALE.
Napier's Bones retains title to and ownership of the software.

This software package is protected under U.S. and international
copyright law.

This is a temporary 30-day use license.  You have 30 days in
which to evaluate this software product without paying a fee.  If
you continue to use this product after the 30-day trial period,
you must register with Napier's Bones and pay the small
registration fee for a permanent license.

It is a violation of copyright law to use an unregistered version
of this software product for longer than the 30-day trial period.

You may transfer this software and license to another party if
the other party agrees to accept the terms and conditions of this
license.

NAPIER'S BONES DISCLAIMS ALL WARRANTIES RELATING TO THIS
SOFTWARE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED
TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND
SPECIFICALLY DISCLAIMED.

NEITHER NAPIER'S BONES NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN
THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE
LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES
ARISING OUT OT THE USE OR INABILITY TO USE SUCH SOFTWARE EVEN IF
NAPIER'S BONES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES OR CLAIMS.

IN NO EVENT SHALL NAPIER'S BONES LIABILITY FOR ANY DAMAGES EVER
EXCEED THE PRICE PAID FOR THE LICENSE TO USE THE SOFTWARE,
REGARDLESS OF THE FORM OF CLAIM.  THE PERSON USING THE SOFTWARE
BEARS ALL RISKS AS TO THE QUALITY AND PERFORMANCE OF THE
SOFTWARE.  Some states do not allow the exclusion of the limit of
liability for consequential or incidental damages, so the above
limitation may not apply to you.

This agreement shall be governed by the laws of the State of
Alabama and shall inure to the benefit of Napier's Bones and any
successors, administrators, heirs and assigns.  Any action or
proceeding brought by either party against the other arising out
of or related to this agreement shall be brought only in a STATE
or FEDERAL COURT of competent jurisdiction located in Montgomery,
Alabama.

If any provision of this statement is found void or
unenforceable, it will not affect the validity of the balance of
this statement, which shall remain valid and enforceable
according to its terms.

All rights not specifically granted in this license agreement are
reserved by Napier's Bones.

By using the Napier's Bones product covered by this license, you
agree to become bound by its terms.
