Unique Identifier : AIDSLINE ASHM6/95291905 AB This paper discusses the legal issues raised by two recent cases; the first of which involved patient to patient transmission and the second of which involved an HIV-infected health care worker. The paper examines whether law can resolve the complex issues raised by these cases and the extent to which existing legal rules actually contribute to breaches of confidence and discrimination. It suggests that law can provide only limited protection to people with HIV/AIDS and that medical practitioners and health care may need to make substantial behavioural changes in the future.
