James Dorsey sued the government for monetary damages, alleging the Labor Department violated Section 504 of the Rehabilitation Act of 1973 by discriminating against him based on his disability. A three-judge panel ruled that the Federal government had not waived its sovereign immunity from private suits seeking damages under Section 504.
