Unique Identifier : AIDSLINE AIDS/95700285 AB The Minnesota State Supreme Court ruled that a doctor's wife cannot collect damages arising from the publication of studies which revealed her late husband's positive HIV status. The court stated that the spouse is not entitled to recover damages on behalf of her late husband because the personal injury she claimed he suffered does not survive after his death. It stated that a jury would be hard-pressed to decide on the extent or nature of a claim of emotional distress if the party involved was not able to testify at trial.
